Erosion and Settlement Control

Erosion and sediment control is essential in Comox because Bylaw 1824 protects the Town’s drainage system, natural watercourses, and neighbouring properties from damage caused by runoff during construction. The bylaw prohibits sediment and other harmful materials from entering the storm system, requires ESC plans or controls based on project risk, and sets standards for site preparation, stabilization, and monitoring, especially during heavy rain. These measures prevent clogged drains, flooding, land instability, and water-quality impacts, helping protect infrastructure, the environment, and the community as Comox grows.

Under Bylaw 1824, an ESC permit (and full ESC plan) is required for subdivision servicing, any non-minor building permit, or when construction involves significant land disturbance such as moving more than 1m of soil over an area larger than 150 m², removing large numbers of trees, or working on steep or sensitive sites. Smaller projects that meet the definition of “Minor Development” may be exempt from providing a full ESC plan only if the work is low-risk, ie. the disturbed area is limited, soils and slopes are stable, fewer trees are removed, and the work is not occurring during the wet season.
